Terms of Use
Effective October 15, 2026
The short version
- Be kind. Forkcast has zero tolerance for objectionable content or abusive behavior, and we remove content and suspend accounts that break these rules.
- You own what you post; you let us show it in Forkcast.
- AI suggestions and place details can be wrong. Check before you go.
- You can report or block anyone, and delete your account at any time.
These Terms of Use ("Terms") are an agreement between you and RADICAL16, INC. ("Forkcast", "we", "us") and govern your use of the Forkcast app and this website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Who can use Forkcast
You must be at least 13 years old, and old enough to agree to these Terms where you live. You must give accurate account information, keep your password secure, and not share your account. You're responsible for activity on your account. We may refuse or suspend accounts that were created to evade a previous suspension.
2. Your content
"Your content" means what you post on Forkcast, including spots, lists, reviews, ratings, photos, comments, and your profile. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and distribute your content only to operate, improve and promote the Service (for example, showing your review to other members). This license ends when you delete the content or your account, except for copies that other members have already shared outside Forkcast.
You confirm that you have the rights to everything you post, and that your content doesn't violate anyone's rights or these Terms.
3. Community rules
Don't post or do anything that:
- Harasses, bullies, threatens or intimidates anyone, or encourages others to.
- Promotes hate or discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or any other protected characteristic.
- Contains nudity, sexual content, or sexualizes minors in any way.
- Shows or promotes violence, self-harm, or dangerous or illegal activity.
- Is spam, a scam, misleading, or fake (including fake reviews, reviews written in exchange for payment without disclosure, and reviews of businesses you own or compete with).
- Impersonates someone, or shares someone else's private information without their permission.
- Infringes copyright, trademark or other rights, including posting photos you didn't take and don't have permission to use.
- Tries to access accounts or data that aren't yours, interferes with the Service, or scrapes it, reverse-engineers it or uses it to build a competing product.
4. Reporting, blocking and enforcement
You can report any post, comment or account from the "…" menu, and block any account from its profile. Our moderators review reports, generally within 24 hours. We may filter, remove or restrict content, and warn, suspend or permanently remove accounts, that we believe break these Terms or put others at risk, with or without notice. If you believe we made a mistake, email support@radical16.com.
5. Places, reviews and AI suggestions
Place details come from Apple Maps and from members. Reviews are the opinions of the members who write them, not of Forkcast. Suggestions labeled "Suggested by Gemini" are generated by AI and checked against Apple Maps, but they can still be inaccurate, incomplete or out of date. Always confirm hours, prices, allergens and other details yourself. Forkcast doesn't endorse, and isn't responsible for, any restaurant, business or place.
6. Our service
Forkcast and its software, design and branding belong to RADICAL16, INC. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, as allowed by these Terms and the App Store's usage rules. We may change, add or remove features, and we may stop providing the Service. If we shut Forkcast down, we'll try to give you reasonable notice.
7. Ending your account
You can delete your account at any time in the app (You → Account → Delete account), which deletes your content as described in our Privacy Policy. We may suspend or end your access if you break these Terms. Sections 2 (for content already shared), 8, 9, 10 and 12 continue to apply after your account ends.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY CONTENT, PLACE INFORMATION OR AI SUGGESTION IS ACCURATE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FORKCAST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, ANY CONTENT, OR ANY PLACE YOU VISIT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME PLACES DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
10. Indemnity
To the extent permitted by law, you agree to indemnify RADICAL16, INC. against claims arising from your content or your breach of these Terms.
11. Apple App Store terms
If you downloaded Forkcast from Apple's App Store:
- These Terms are between you and RADICAL16, INC. only, not Apple. Apple is not responsible for Forkcast or its content.
- Apple has no obligation to provide maintenance or support for Forkcast.
- If Forkcast fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for Forkcast.
- Apple is not responsible for addressing any claims by you or a third party relating to Forkcast, including product liability claims, claims that it fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that Forkcast infringes someone's intellectual property.
- You confirm that you're not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you're not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms (such as your wireless carrier's) when using Forkcast.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. General
These Terms are governed by the laws of the United States and the state in which RADICAL16, INC. is organized, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise. If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You may not transfer these Terms; we may transfer them as part of a merger or acquisition. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
We may update these Terms. We'll post changes here and update the effective date, and for significant changes we'll let you know in the app. If you keep using Forkcast after a change takes effect, you accept the updated Terms.
